These Terms and Conditions (the “Terms”) govern your access to and use of the FCPrep website, products, and related services (collectively the “Services”). By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must cease use of the Services immediately.

These Terms constitute a legally binding agreement between you and FCPrep and operate in accordance with the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”) and the Consumer Protection Act 68 of 2008 (“CPA”).

1. ACCEPTANCE AND CHANGES

By accessing our website and purchasing subscriptions, you agree to these Terms. We reserve the right to revise these Terms at any time. We will notify you of material changes by email or via a prominent notice on the Service. Continued use of the site after the effective date constitutes acceptance of the updated Terms. You may be required to click an “I agree” box when creating an account or upgrading your subscription; this constitutes valid acceptance under section 11 of ECTA.

2. DEFINITIONS

  • “Content” means all questions, explanations, graphics, layout, software, flashcards, clinical guides, and any other educational material made available through FCPrep.
  • “Personal Information” has the meaning assigned to it in the Protection of Personal Information Act 4 of 2013 (“POPIA”).
  • “Subscription” means a paid agreement for access to the FCPrep platform and its Services.

3. DESCRIPTION OF SERVICES

FCPrep is an educational platform providing medical professionals and trainees with examination preparation and revision resources. While we strive to provide accurate, up-to-date, and uninterrupted access, we do not guarantee that the website will be error-free or available at all times. Access may be suspended for maintenance, repairs, or updates. To the extent permitted by law, we are not liable for any downtime or discontinuation of specific features.

4. REGISTRATION, ELIGIBILITY, AND SECURITY

The Service is intended for adults engaged in medical training or clinical practice. By creating an account, you represent that you have the legal capacity to enter into this agreement.

Mandatory Information:
You must provide current, complete, accurate, and verifiable information when registering for the Service, including a valid Health Professions Council of South Africa (HPCSA) registration number and a valid cellular phone number. Providing false, misleading, impersonated, fraudulent, or unverifiable information constitutes a material breach of these Terms.

Prohibited Methods:
Use of temporary, disposable, or “burner” email addresses, as well as the use of technical methods intended to conceal identity, location, or access activity in a manner that compromises platform integrity or security, may result in restricted or denied access to the Service.

Account Confidentiality:
Your account is personal, non-transferable, and intended for individual use only. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account. Sharing account credentials, concurrent account use, or unauthorized account access may be monitored and detected through technical security measures.

Enforcement and Suspension:
We reserve the right to suspend, restrict, verify, or terminate accounts where we reasonably suspect:

  • inaccurate or misleading registration information;
  • unauthorized account sharing or access;
  • fraudulent, abusive, or unlawful conduct; or
  • conduct that compromises the integrity, security, or operation of the platform.

Where a suspension or termination occurs due to a breach of these Terms, we reserve the right to refuse refunds to the extent permitted by applicable law. FCprep shall not be liable for losses arising from unauthorized access to your account resulting from your failure to maintain credential security.

5. SUBSCRIPTION, PAYMENT, AND CANCELLATION

  • Duration and Access: Access is granted for the specific term purchased. Subscriptions begin immediately upon activation. Subscriptions cannot be paused, suspended, or reactivated at a later date.
  • Pricing and Payments: Prices include all applicable taxes unless otherwise stated. Payments are processed via secure third-party gateways. FCPrep is not liable for the failures or security breaches of these third-party providers.
  • Fixed-Term Agreements (CPA Section 14): If you purchase an annual subscription, it is a fixed-term agreement. We will notify you of your plan’s upcoming expiry in accordance with the CPA. Your annual subscription will not be automatically renewed for a further fixed term without your express consent.
  • Cooling-Off Rights (ECTA Section 44): ECTA provides a 7-calendar-day cooling-off right for online subscriptions. However, by subscribing and accessing digital Content, you consent to us providing the Service immediately. Accessing Content before the 7-day period expires constitutes a waiver of your right to cancel without charge.
  • Strict No-Refund Policy: Because our Services are digital and provided immediately, all purchases are final and non-refundable upon access to Content. We do not provide credits or pro-rata refunds for partial use or early cancellations.

6. INTELLECTUAL PROPERTY

All Content and “Licensed Materials” on the Service are the sole property of FCPrep or its licensors, protected by South African copyright law (Copyright Act 98 of 1978) and applicable international treaties.

You are granted a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial educational use. You may not reproduce, distribute, “scrape,” modify, publicly display, or create derivative works from our content. Any breach of intellectual property rights will result in immediate termination of access and potential legal action.

7. USER CONDUCT AND PROHIBITED ACTIONS

You agree not to:

  • Use the site for fraudulent, unlawful, or commercial purposes.
  • Engage in “rapid browsing” or use bots, scrapers, or automated systems to harvest data.
  • Post or share any content that identifies real patients or includes confidential patient clinical records.
  • Abuse or harass FCPrep staff or other users. We maintain a zero-tolerance policy for abusive communication; violation results in an immediate ban without refund.

8. DATA PROTECTION AND PRIVACY

Your use of the Services is subject to our Privacy Policy. We collect, process, store, and protect your personal information strictly in accordance with POPIA. By using this site, you consent to such processing to provide the Services, enable core functionality, and ensure platform security.

9. MEDICAL DISCLAIMER

Educational Purpose Only: FCPrep is a revision and examination preparation resource. It does not constitute medical advice, a clinical opinion, a diagnosis, or a treatment plan.

  • Not a Substitute for Clinical Judgment: Medical data changes frequently. This material is not a substitute for professional medical assessment or independent clinical judgment.
  • Verification Required: Drug dosages, protocols, and guidelines presented must always be verified against official local formularies (e.g., SAMF), institutional protocols, and current specialist guidelines before any clinical application.
  • No Guarantee of Results: FCPrep makes no guarantee that the use of our Services will result in passing any official examination or achieving specific academic outcomes.

10. LIMITATION OF LIABILITY

PLEASE READ CAREFULLY: This section limits our legal liability to you to the maximum extent permitted by the CPA and other applicable South African laws.

  • “As Is” Basis: The Services are provided on an “as is” and “as available” basis without any express or implied warranties of any kind.
  • Exclusion of Indirect Damages: FCPrep, its directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or professional standing.
  • Liability Cap: Our total cumulative liability to you for any and all claims shall not exceed the total amount actually paid by you to FCPrep for the specific subscription giving rise to the claim during the three (3) months immediately preceding the event.
  • Clinical/Professional Failure: FCPrep accepts no responsibility for clinical outcomes, adverse patient events, or academic consequences arising from reliance on any Content from this platform.

11. INDEMNITY

You agree to indemnify, defend, and hold harmless FCPrep and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your violation of these Terms;
  • Your infringement of any third-party intellectual property rights;
  • Any unauthorized use of your account;
  • Any clinical or professional decision made by you in reliance on platform Content.

12. TERMINATION

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any material breach of these Terms, or for conduct we reasonably deem harmful to the platform, our staff, or other users, including the provision of false, misleading, unverifiable, fraudulent, or impersonated professional registration information. Upon termination, clauses intended to survive termination — including Intellectual Property, Medical Disclaimer, Limitation of Liability, and Indemnity — shall remain in full force and effect.

13. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. If a dispute arises, you agree to first contact us to seek an informal resolution. Should that fail, you consent to the exclusive jurisdiction of the South African courts for any dispute arising from this agreement.
